Terms of Use (TOU) – Yebwou

These Terms of Use (“TOU”) govern access to and use of the Yebwou mobile and web application (“the Application”), a platform that enables users to order, pick up, and have products and services delivered from partner merchants.

By accessing or using the Application, the user acknowledges having read, understood, and accepted these TOU without reservation.

 

1. Purpose of the Application

Yebwou provides a secure digital interface connecting:

  • Users, who wish to order products or services;

  • Partner merchants, who offer these products or services;

  • Independent delivery drivers, who handle deliveries.

Yebwou operates solely as a technical intermediary.
The platform is not a seller, transporter, producer, or service provider.

 

2. Access and Account Creation

2.1 Access to the Application

The Application is accessible via:

  • Android smartphones

  • Web application

A stable internet connection is required.

2.2 Account Creation

A user account is required to place orders.
The following information must be provided:

  • First and last name

  • Phone number

  • Email address

  • Password

The user must provide accurate, complete, and up-to-date information.

2.3 Account Security

The user is fully responsible for:

  • Keeping their password confidential

  • All actions performed through their account

  • Immediately notifying Yebwou of any fraudulent or unauthorized use

 

3. Service Operations

3.1 Orders

An order becomes final and binding once validated by the merchant.

Displayed prices include taxes, service fees, and delivery fees (if applicable).

All product images and descriptions are provided by partner merchants.
Yebwou is not responsible for:

  • Visual variations

  • Errors or inaccuracies from merchants

  • Out-of-stock situations

3.2 Delivery

Deliveries are carried out by independent drivers.

While Yebwou takes all reasonable measures to facilitate fast delivery, the platform cannot be held responsible for:

  • Delays

  • Traffic issues

  • Weather conditions

  • Driver unavailability

Merchants remain fully responsible for the quality, freshness, and compliance of products.

3.3 In-Store Pickup

Pickup must occur during the merchant’s operating hours.
The user must show their order number at pickup.

No exchange is possible after pickup, except in cases of:

  • Defective product

  • Clear merchant error

  • Non-conforming product

 

4. Payments & Cashback

4.1 Payments

Accepted payment methods include:

  • Mobile Money

  • Bank cards

  • Cash (depending on merchant or driver)

All online payments are encrypted and secured.

4.2 Cashback Program

Cashback is automatically credited to the user’s account after eligible orders.

  • Cashback can be used only as a discount on future orders.

  • It cannot be converted into cash unless explicitly stated in the Application.

  • Yebwou may adjust cashback rates at any time with prior notification.

 

5. Reviews, Ratings, and Community Interactions

Users may rate and review:

  • Merchants

  • Delivery drivers

  • Their overall experience

Rules:

  • Reviews must be honest, objective, and respectful

  • No insults, threats, discrimination, or defamatory comments

  • No reviews given in exchange for incentives

Yebwou reserves the right to remove non-compliant reviews.

 

6. Responsibilities

6.1 Responsibility of Yebwou

Yebwou is not responsible for:

  • Delivery delays

  • Stock shortages

  • Poor product quality

  • Damages caused by merchants or delivery drivers

  • Misuse of the Application by the user

However, Yebwou commits to:

  • Providing responsive customer support

  • Assisting in resolving serious issues

  • Taking action against non-compliant merchants or drivers

6.2 Responsibility of the User

Users agree to:

  • Use the Application legally

  • Not place fraudulent or abusive orders

  • Respect payment terms

  • Not harass merchants or drivers

 

7. Intellectual Property

All content within the Application—including logos, text, visuals, interface design, and functionalities—is the exclusive property of Yebwou.

Any reproduction, distribution, or commercial use without permission is strictly prohibited.

 

8. Prohibited Conduct

It is strictly forbidden to:

  • Use the Application for illegal purposes

  • Harass, threaten, or insult anyone

  • Create multiple accounts to exploit the system

  • Manipulate reviews or the cashback system

  • Attempt to exploit or hack any feature of the Application

Violations may result in:

  • Account suspension

  • Permanent account deletion

  • Legal action if necessary

 

9. Personal Data Protection

Yebwou commits to:

  • Protecting all user data

  • Never selling personal data to third parties

  • Encrypting all sensitive information

In accordance with applicable data protection laws, users may request:

  • Access to their data

  • Modification of their data

  • Deletion of their data

 

10. Modification of the TOU

Yebwou may update these TOU at any time.
Continued use of the Application constitutes acceptance of the updated terms.

 

11. Governing Law & Jurisdiction

These TOU are governed by the laws of the country where Yebwou operates.
Any dispute shall be submitted to the competent courts of Yebwou’s registered headquarters.
